Welcome to Rentfy. These Terms of Service ("Terms") govern your access to and use of our rental platform, website, and services. By accessing or using Rentfy, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using Rentfy, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.
2. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use our services. By using Rentfy, you represent and warrant that you meet these requirements.
3. Account Registration
To use certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. User Responsibilities
As a user of Rentfy, you agree to:
- Provide truthful and accurate information in all listings and communications
- Comply with all applicable local, provincial, and federal laws
- Not use the platform for any illegal or unauthorized purpose
- Not interfere with or disrupt the platform or servers
- Not use automated systems to access the platform
- Respect the intellectual property rights of others
- Not harass, abuse, or harm other users
- Not post false, misleading, or fraudulent content
5. Listing Properties
If you list a property on Rentfy, you agree to:
- Have the legal right to rent the property
- Provide accurate property descriptions and photos
- Disclose all material facts about the property
- Set fair and accurate pricing
- Respond to inquiries in a timely manner
- Comply with all applicable landlord-tenant laws
- Maintain proper insurance coverage
6. Fees and Payments
Rentfy operates on a membership model with the following tiers:
- Free: Basic listing features
- Basic ($19.99/month): Enhanced features
- Premium ($49.99/month): Advanced features and priority support
- Enterprise ($149.99/month): Full suite of professional tools
All fees are non-refundable unless otherwise stated. We reserve the right to change our pricing with 30 days notice.
7. Prohibited Conduct
You may not:
- Discriminate against any person based on protected characteristics
- Post content that is defamatory, obscene, or offensive
- Engage in fraudulent or deceptive practices
- Collect or harvest user information without consent
- Transmit viruses or malicious code
- Attempt to gain unauthorized access to our systems
- Use the platform for commercial solicitation unrelated to rentals
- Create multiple accounts to circumvent restrictions
8. Intellectual Property
All content on Rentfy, including text, graphics, logos, images, and software, is the property of Rentfy or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content without our prior written permission.
9. Third-Party Services
Our platform may integrate with third-party services (payment processors, mapping services, etc.). Your use of these services is subject to their respective terms and conditions. We are not responsible for the actions or policies of third-party providers.
10. Disclaimers
Rentfy is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, including:
- Merchantability and fitness for a particular purpose
- Non-infringement of third-party rights
- Accuracy, completeness, or reliability of content
- Uninterrupted or error-free service
- Security of data transmission
We do not guarantee that listings are accurate or that transactions will be completed successfully.
11. Limitation of Liability
To the maximum extent permitted by law, Rentfy and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses arising from your use of our services. Our total liability shall not exceed the amount you paid to us in the past 12 months.
12. Indemnification
You agree to indemnify, defend, and hold harmless Rentfy and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the platform, your violation of these Terms, or your violation of any rights of another party.
13. Dispute Resolution
Any disputes arising from these Terms or your use of Rentfy shall be resolved through:
- Good faith negotiations between the parties
- Mediation, if negotiations fail
- Binding arbitration in Vancouver, British Columbia
- Governed by the laws of British Columbia and Canada
14. Termination
We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately.
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through the platform. Your continued use after such changes constitutes acceptance of the modified Terms.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
